Mark M. Heinish is a 1984 graduate of Binghamton University, State University of New York, where he received his Bachelor of Arts in History. He obtained his Juris Doctor in 1993 from the University of Miami School of Law. He is admitted to practice law in the State of Florida, State of New York, and the United States District Court for the Southern District of Florida.
Mr. Heinish has maintained an extensive litigation practice throughout his career. He has experience in insurance defense and general civil and professional liability matters and he has handled both defense and coverage issues. Mr. Heinish has significant experience representing condominium and homeowners’ associations as well as in other real estate matters, including title agent defense. As a result, he is well-versed in condominium and homeowners’ association law, including directors’ and officers’ liability matters. Throughout his career, he has been active in regulatory and legislative matters and has drafted a number of ordinances for Miami-Dade County. He drafted Senate Bill 1986, sponsored by State Senator Jeremy Ring and signed into law by Governor Charlie Christ in 2008.
Mr. Heinish is also experienced in appellate law and has handled several precedent-setting cases in the Florida district courts of appeal, including Pond Apple Place III Condominium Association, Inc. v. Joy Russo , 841 So.2d 526 (Fla. 4th DCA 2003), which ensured a condominium association’s authority to enforce its governing documents, and Dunkley Stucco, Inc. v. Progressive American Insurance Company , 751 So.2d 723 (Fla. 5th DCA 2000), which established a legal definition for liquidated damages. He also has experience in consumer class action and consumer protection matters.
Mr. Heinish has also been qualified by the Florida Supreme Court to perform arbitrations and is maintained by the 17th Judicial Circuit’s Court Mediation and Arbitration Program as a Supreme Court qualified arbitrator. He has also been appointed guardian ad litem in real estate foreclosure matters.
Mr. Heinish was also a high school social studies teacher in New York City and currently spends a portion of his spare time officiating high school and college baseball and football.
